I declare that I am over eighteen (18) years of age and that all information provided in this application is true and correct. I agree to comply at all times with the instructions, rules, regulations, and directions of officials, staff, and representatives of K1 Circuit and/or Champions of the Future America and any sanctioning or organizing bodies associated with the event. I acknowledge and understand that motorsport activities are inherently dangerous and involve risks of serious injury, permanent disability, death, and property damage. I knowingly and voluntarily assume all such risks, whether known or unknown, foreseeable or unforeseeable, and accept full responsibility for my participation in and presence at the event. To the fullest extent permitted by law, I hereby irrevocably waive, release, discharge, and covenant not to sue K1 Circuit and/or Champions of the Future America, its parent companies, affiliates, owners, officers, directors, employees, contractors, agents, officials, volunteers, track owners or lessees, promoters, sanctioning bodies, racing associations, and all related entities (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, losses, liabilities, costs, or expenses of any kind, whether in law or equity, arising out of or related to my attendance, participation, conduct, or presence at the event, including but not limited to claims arising from the negligence of the Released Parties, to the maximum extent allowed under applicable law. I further agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from or related to my actions, omissions, content capture, content distribution, or violation of this agreement. This agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-laws principles. Any legal action or proceeding arising out of or relating to this agreement or the event shall be brought exclusively in the state or federal courts located within the State of California, and I hereby consent to personal jurisdiction and venue therein.
Media Usage & Image Rights Agreement
By checking this box, I expressly acknowledge and agree to the following legally binding terms: Retention of Copyright; Grant of License: I retain ownership of the copyright in photographs, video, audio, or other media content that I personally capture during the event. Notwithstanding the foregoing, I hereby grant to K1 Circuit and/or Champions of the Future America an exclusive, irrevocable, perpetual, worldwide, transferable, sublicensable, and royalty-free license to use, reproduce, copy, modify, adapt, edit, publish, distribute, publicly display, publicly perform, archive, and otherwise exploit any and all such media content, in whole or in part, in any format or medium now known or hereafter devised, for any lawful purpose, including but not limited to promotional, marketing, advertising, commercial, editorial, educational, and archival uses. Exclusivity: The license granted herein is exclusive to K1 Circuit and/or Champions of the Future America, meaning that K1 Circuit and/or Champions of the Future America may use the media content without restriction and may authorize third parties to do so. I may continue to use my own content for personal portfolios, self-promotion, and non-competing editorial purposes, provided such use does not imply endorsement by K1 Circuit and/or Champions of the Future America or conflict with K1 Circuit and/or Champions of the Future America’s commercial exploitation of the content. Image Delivery Obligation: Upon written or electronic request by K1 Circuit and/or Champions of the Future America, I agree to deliver selected images or media captured during the event within forty-eight (48) hours of such request, in the original or high-resolution format reasonably requested by K1 Circuit and/or Champions of the Future America. No Watermarks or Restrictions: All images or media provided to K1 Circuit and/or Champions of the Future America must be delivered free and clear of any watermarks, logos, metadata restrictions, overlays, copyright notices, or technical or contractual limitations that would restrict K1 Circuit and/or Champions of the Future America’s use of the content. Moral Rights Waiver: To the fullest extent permitted by law, I hereby waive any and all moral rights, rights of attribution, or rights of integrity with respect to the media content. Credit; No Compensation: Any credit provided by K1 Circuit and/or Champions of the Future America is discretionary and not guaranteed. I acknowledge and agree that no compensation, royalties, fees, or other payment of any kind shall be owed to me for K1 Circuit and/or Champions of the Future America’s use of the media content under this agreement. Failure to provide credit shall not constitute a breach of this agreement. Registration & Access Control: All individuals operating photographic, video, or recording equipment in the paddock, pit lane, or on-track areas must be properly registered and approved by K1 Circuit and/or Champions of the Future America. K1 Circuit and/or Champions of the Future America reserves the right to revoke credentials at any time, with or without cause, at its sole discretion. Branding Restrictions: No media party may display or promote company names, logos, trademarks, or branding on karts, buildings, apparel, equipment, or event infrastructure without the prior written consent of K1 Circuit and/or Champions of the Future America. Non-Compete / Competitive Use Restriction: I agree that I shall not license, sell, assign, or otherwise authorize the use of any event-related media content to any competing racetrack, karting facility, racing series, promoter, or sanctioning body for commercial or promotional purposes, without the prior written consent of K1 Circuit and/or Champions of the Future America. This restriction shall not apply to bona fide news reporting or non-sponsored editorial coverage that does not promote a competing venue or series.
Separate Acknowledgment – Image Rights
I have read, understand, and voluntarily agree to the Media Usage & Image Rights Agreement above. I acknowledge that while I retain copyright ownership of my content, I am granting K1 Circuit and/or Champions of the Future America an exclusive, perpetual, and irrevocable license to use such content as described, and that this grant materially affects my rights.
